Release or ‘freedom to operate’ are terms which can be used concomitantly and which refer to an investigation that is carried out before the market launch of a product or method to determine whether your product or method possibly infringes one or more third-party patents.

A freedom-to-operate study can spare a manufacturer a number of headaches, particularly if a study of this type indicates that certain aspects of a product are not “free”, and this can be established at an early stage. An alternative technology, for example, can then be used or developed (design-around).
