In order to instigate a patent nullification action in proceedings on the merits in the Netherlands, it is mandatory first to carry out an advisory procedure through the patenting body, i.e. the NL Agency. Even if you do not immediately intend to invoke the invalidity of a patent before the court, it may be sensible to carry out an advisory procedure of this type with the NL Agency. In this case, the agency will provide a (non-binding) assessment of the validity of the patent. This assessment may be helpful in any negotiations with the patent holder.
