A development agreement is usually entered into by parties who hold an intellectual property right which is of interest to each of them and who make arrangements on the basis of this agreement concerning the new products or methods to be developed in the future. A reciprocal cross-licence is often issued so that both parties can innovate on the basis of this cooperation. A development agreement can therefore be a cooperation agreement. The development agreement can also apply to one party who wishes to elaborate on the existing right of a third party or who requires a licence to the right of a third party in order to be able to innovate.
