Outside activities and memberships:
Michiel is a registered expert with various courts in the Netherlands and Belgium. He is a member of the AIPPI and EPI. He has been a member of the legal committee of the Institute of Patent Attorneys since 2007. For a number of years, he also gave lectures to trainee patent attorneys at the CEIPI in Strasbourg.
Michiel regularly attends conferences such as the INTA on behalf of Arnold + Siedsma. On the “Eindhoven circuit”, you may bump into Michiel at ‘Open Coffee’ and in the local departments of the BNI and Redpeppers.

Case:
A Dutch client noticed that a competitor was selling a product that would almost certainly entail a patent infringement. This often happens, but in this case it happened in a prominent place, i.e. one of the biggest trade fairs in Belgium.

Michiel was contacted by his client in the afternoon. He advised the client to arrange the execution of a descriptive seizure order. Test samples were taken by an expert and subsequently described in a report. If necessary, the product is actually also taken.

Michiel immediately contacted a Flemish lawyer. The lawyer engaged the services of both an independent expert and the bailiff. As early as the following morning, the petition, including the necessary documents, was filed with the court in Belgium.

The case was treated with high urgency by the Brussels court. The court agreed with the case and issued the official ruling with which the seizure could be imposed. Together with the bailiff, the expert and the lawyer, the items were inspected and studied and some of them were seized. The competitor then refrained from further displaying comparable products.

In the event of possible patent infringement, Michiel takes immediate action to examine whether the imitation invention can be taken off the market. He has played a successful key role in this area on a number of occasions.

Rights can be safeguarded in different ways. Michiel has shown himself to be an outstanding negotiator. He never loses sight of the commercial interests of his clients. He combines an accurate assessment of the chances of winning or losing with an awareness of the associated costs. He also regularly conducts the negotiations for various clients when granting or acquiring a licence for patented products.
